Scope determinations
ATVOD has a duty to determine whether service providers have complied with the obligation to notify set out in section 368BA of the Communications Act 2003 and incorporated into the ATVOD Rules as Rule 1.
Before reaching a determination that a breach of this statutory obligation has taken place, ATVOD informs the service provider of its preliminary view and invites the service provider to make representations. Any such representations are considered by the ATVOD Board before a final decision is taken. Service providers can appeal to Ofcom with regard to a determination that a breach of the obligation to notify has occurred.

This Determination was the subject of an appeal to Ofcom. In its decision published on 12 July 2012, Ofcom quashed the Determination and referred the matter back to ATVOD for reconsideration. On 3 October 2012, ATVOD determined that the three Viacom companies (Comedy Central, MTV and Nickelodeon) each had editorial responsibility for the ODPS comprising their video on demand content on the Sky Anytime platform (see the Comedy Central, MTV and Nickelodeon determinations published above) .
